Dan and Kip have extensive experience in negotiating and documenting the business of international agricultural law including documenting loans and distribution agreements between United States Distributors and growers in the Republic of Mexico and other foreign countries. This documentation not only includes the basic contract and loan documents but also filing the necessary notices required to perfect the security interests securing repayment of loans under the Uniform commercial Code (UCC) in the United States as well as the Registro Unico de Garantias Mobiliarias (RUG) in Mexico which is coordinated with Mexican legal counsel.

Dan and Kip also have over 30 years of experience representing companies and individuals in both disciplinary and reparations proceedings before the United States Department of Agriculture under the Perishable Agricultural Commodities Act (“PACA”) as well as in lawsuits brought in State and Federal Courts.

Dan and Kip have also been involved in the negotiation and implementation of Tomato Suspension Agreements between the United States Department of Commerce and certain growers in the Republic of Mexico from the very first agreement in 1996 to the latest agreement in 2019. Dan and Kip are also thoroughly familiar with the documentation, record keeping and reporting necessary to successfully comply with the Tomato Suspension Agreement.
